At Fault Driver’s Blood Alcohol Content Was Nearly Three Times the Legal Limit

In July 2025, Summer Poole was riding her motorcycle on Whiskey Road in Aiken, when a car suddenly pulled out in front of her. In an attempt to avoid hitting the car, she crashed into the median and was ejected from her motorcycle. First responders pronounced her dead at the scene of the accident.

The driver who caused the accident, Christopher Hogan, remained at the scene of the accident until police arrived. The police suspected that he was under the influence of alcohol, and he took a breathalyzer test, which showed that his blood alcohol content (BAC) was about three times the legal limit. You can be convicted of drunk driving if your blood alcohol content is greater than or equal to 0.08 percent.

Hogan, 55, was taken to jail and held without bail after the accident. No additional news reports have appeared about the criminal case against him. People who cause fatal traffic accidents while driving drunk can face charges up to and including DUI manslaughter. Regardless of the outcome of the criminal case against Hogan, Poole’s surviving family members have the right to file a wrongful death lawsuit in civil court. They have a chance of prevailing in a civil lawsuit against Hogan even if he is not convicted. South Carolina also has a dram shop liability law that entitles people injured in drunk driving accidents to seek compensation from the bar that served alcohol to the drunk driving; if Hogan got drunk at a bar before the accident, Poole’s family may file a dram shop liability claim against the bar.
