Husband and Wife Die After Car Crashes into Their Motorcycle in Lugoff

Kershaw County Grandparents Killed in Motorcycle Accident

The accident happened on Highway 1 in Lugoff, close to Longton Road.  On the morning of July 2, Ned and Barbara Wymer took a ride on Ned’s motorcycle.  At about 9:10 in the morning, they were riding past an area of road construction, where all vehicles were required to slow down.  Ned reduced his speed so that he could pass the construction site safely, but the driver of the car behind him waited too long to start decelerating.  The driver was not able to stop in time to avoid hitting the motorcycle.  When the car hit the motorcycle from behind, Ned and Barbara both went flying off the motorcycle.  Ned was pronounced dead at the scene at age 72.  Barbara died of her injuries several hours later at the hospital; she was 72.  The driver of the car was taken to the hospital for treatment, but he is expected to make a full recovery.  The WIS News website did not release the driver’s name or age or the make and model of the car.

The Legal Issues

The surviving family members of Ned and Barbara Wymer have the right to file a wrongful death lawsuit against the driver of the car that struck their motorcycle.  If they win their case, they can recover damages for funeral expenses, as well as noneconomic damages for emotional distress and loss of companionship.  In this case, the family probably cannot recover damages for lost income, because the victims were of retirement age.  The family could have a case against the city if an investigation reveals that the crash could have been prevented if the construction work had been planned differently.  The driver of the car did not flee the scene, and alcohol does not seem to be a factor in the crash, but he could face criminal charges for vehicular homicide.
